MASS Engines knows that you care about how the personal data we receive about you is used and shared, and we take your privacy seriously. This Privacy Notice describes MASS Engines’ privacy practices in relation to information that we collect through websites operated by us from which you are accessing this Privacy Notice (collectively, “This Website”), through the software applications made available by us for use on or through computers and mobile devices that link to this Privacy Notice (the “Apps”), through our social media pages and apps (collectively, the “Social Media Pages”), and other services provided by us both online and offline; as well as through email messages that we send to you that link to this Privacy Notice (collectively, including the Domains, the Apps and the Social Media Pages, the “Sites”). “You” or “user” refers to any individual who visits or otherwise uses the Sites. 

This Privacy Notice does not apply to the practices of third parties that MASS Engines does not own or control, or to individuals that MASS Engines does not employ or manage. 

We may ask you to provide Personal Information when you:

  • Contact Us, including for Sales or Technical Support;
  • Participate in a marketing/sales promotion or an online survey;
  • Subscribe to our newsletters, promotional emails or other materials;
  • Request information about our products, quotes, downloads or white papers;

Personal Information we request may include your email address, name, home address, billing information and telephone number. We may also collect demographic information, such as your business or company information, age, gender, interests, preferences, and geographic location. Forms that you choose to complete will indicate whether information requested is mandatory or voluntary.

We may collect information about your visits to This Website, including the pages you view, the links and advertisements you click, search terms you enter, and other actions you take in connection with This Website. We may also collect certain information when you visit This Website, such as your Internet Protocol (IP) address, browser type and language, access times, the Uniform Resource Locator (URL) of the website that referred you to This Website and to which URL you browse away from our sites if you click on a link on our sites. We may also collect information when you open email messages from us or click on links within those email messages.

We may combine the information we collect as a result of your interactions with us with information obtained through other sources to offer you a more consistent and personalized experience in your interactions with us. 

We use Personal Data: 

  • To respond to your inquiries and fulfill your requests, such as to send you requested materials and newsletters, as well as information and materials regarding our services.

Our legal basis for collecting and using the Personal Data described above will depend on the Personal Data concerned and the specific context in which we collect it.  We will collect and use your Personal Data where the processing is in our legitimate business interests, such as for direct marketing and sales and Applications to prospective Business-to-Business (B2B) customers.  Our legal basis for processing Personal Data in certain circumstances will also be based on your consent to do so or where we need the Personal Data to perform a contract with you or in order to enter into a contract with you. In some cases, we may also have a legal obligation to collect Personal Data from you.

If we ask you to provide Personal Data to comply with a legal requirement or to enter into a contract with you, we will make this clear at the relevant time and advise you whether the provision of your Personal Data is mandatory or not (as well as of the possible consequences if you do not provide your Personal Data).  

Disclosing Personal Information

We may share Personal Information with our affiliated and subsidiary companies or Business Partners to carry out transactions you request, to make our business more responsive to your needs, to provide you with information about our products and services, or for research and analysis. We may also disclose Personal Information in connection with legal orders from law enforcement or other government bodies; as required by law or regulation; to protect our rights as well as those of our affiliated and subsidiary companies, our customers, the public, or others; to combat fraud or criminal activity; or with your consent.

In addition, we may share Personal Information with Business Partners that help us or our affiliated and subsidiary companies carry out transactions you request, customize, analyze and/or improve our communications or business relationship with you. Such Business Partners may include a payment processor to bill you for services and an email service provider to send out emails on our behalf. These communications may include requests relating to our products or services. We will only share Personal Information with Business Partners who share our commitment to protecting your Personal Information. Except as described above, we will not disclose Personal Information to third parties for their own marketing purposes unless you have provided consent.

We may share information with a purchaser of all or part of the companies or products comprising our portfolio, including our affiliated and subsidiary companies.

We may aggregate or de-identify information so that it does not identify you and share that and other non-Personal Information with third parties for any purpose.

Selecting Your Communications Preferences and Opting Out of Marketing

You may choose to receive or not receive marketing communications from us by indicating your preferences. If you would prefer not to receive future marketing communications, or wish to change or modify information previously provided or delete inaccuracies, please email info [at] massengines [dot] com. We will retain your Personal Information for as long as your account is active or as needed to provide you services and as necessary to comply with our legal, regulatory or compliance obligations. Even if you opt out of receiving marketing communications, we may still communicate with you in connection with servicing your account, fulfilling your request, or administering any promotion or any program in which you may have elected to participate.

Mass Engines Blog and Social Media Pages

Personal Data may also be disclosed by you through the Sites, on message boards, chat, profile pages and blogs and other services to which you are able to post information and materials. This information can appear in public ways, such as through search engines or other publicly available platforms, and can be “crawled” or searched by third parties. Please do not post any information that you do not want to reveal to the public at large. 

This Website includes social media features, including Facebook “Like” button and Twitter “Follow” button. These features may collect your IP address, which page you are visiting on This Website, and may set a cookie to enable the Feature to function properly. Social media features are either hosted by a third party or hosted directly on This Website. Your interactions with these features are governed by the privacy policy of the company providing it.

Business Transfers

In some cases, we may buy or sell assets or businesses. In these types of transactions, user information is typically one of the business assets that is transferred. MASS Engines will disclose Personal Data to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings). 

Profiling and Automated Decision-making

MASS Engines combines data obtained to help us determine what products and services might be of interest to you and when you might be ready to make a purchase based on repeated interaction with This Website, emails, and content. MASS Engines marketing and sales personnel are involved in this process and no automated decisions are made that would result in legal effects or similarly significantly affect an individual.

Protection of MASS Engines and Others

We release Personal Data as we believe necessary and appropriate to law enforcement, tax, fraud prevention, credit risk agencies and other companies and organizations for the reasons given in the last bullet point under Section 3 above.

Securing Personal Data

We have implemented appropriate organizational, technical, and administrative measures to protect Personal Data within our organization, including security controls to prevent unauthorized access to our systems. Access, Correct, Amend or Remove Information

If you would like to object to the processing of your Personal Data for direct marketing purposes, please use the mechanisms outlined above.

For your protection, we only implement requests with respect to the Personal Data associated with the particular email address that you use to send us your request, and we need to verify your identity before implementing your request. We will respond to your request within 30 days. 

Please note that we need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting such access, change or deletion.

Retaining Personal Data

We will retain your Personal Data for a period of time consistent with the original purpose of collection, including to pursue our legitimate business interests, comply with our legal obligations, resolve disputes and enforce applicable agreements.

Third Party Sites

This Website may contain links to third-party sites. We cannot control and are not responsible for the privacy practices of such third-party sites. We encourage users to be aware when they leave This Website, and to read the privacy statements of each website they visit. This Privacy Statement applies only to This Website.

How We Use Cookies

International Transfer of Data

Your Personal Data may be stored and processed in any country where we have facilities or in which we engage service providers, and by using the Sites or disclosing information to us you consent to the transfer of information to countries outside of your country of residence, including the United States, Australia, Germany, Ireland, Israel, Japan, and the UK, which could have different data protection rules than those of your country or the country in which you were located when you initially provided the information. Where required, we put in place a solution to ensure that Personal Data transferred outside of the EEA is subject to adequate protection, namely the European Commission Standard Contractual Clauses.
